1Welcome to Taap.bio

These Terms & Conditions, along with our Privacy Policy and any other linked policies (collectively, the "Terms"), govern your use of Taap.bio (https://taap.bio), its applications, and related services (collectively referred to as the "Platform" or "Taap.bio").

When we use terms like "we," "our," or "us" in these Terms, we are referring to CLOUD MIND LINK SOLUTIONS (CMLS), an individual entrepreneurship (Entrepreneur individuel) operated by Christopher Maurice LAFAY, registered in France under SIREN 791 669 401, with its registered office at 13 rue Roger Courtois, 25200 Montbéliard, France. Our EU VAT number is FR75 791 669 401.

2Changes to These Terms

Taap.bio is constantly evolving and improving. From time to time, we may make changes to the Platform or these Terms. We may need to update these Terms to reflect business updates, changes to the Platform, legal or regulatory requirements, or to protect our legitimate interests.

If we make changes that will have a material negative effect on you, we will use our best efforts to notify you at least thirty (30) days before the change takes effect. Your continued use of the Platform after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, please stop using Taap.bio and terminate your account in accordance with Section 10.

3Your Account

To create an account and become a Taap.bio user, you agree to comply with these Terms and confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and legally able to accept these Terms. You must provide us with accurate information about yourself.

If you are using Taap.bio on behalf of a business or another individual, you confirm that you are authorized to agree to these Terms on their behalf.

You are responsible for the security of your account and ensuring it is only used in a lawful manner. We recommend that you create a strong password and do not share it with anyone. If you believe your account has been compromised, please contact us immediately at [email protected].

You must not assign or transfer your account to someone else or use your account (or allow it to be used by anyone) in a way that causes damage to Taap.bio or our reputation, or infringes another's rights or applicable laws and regulations. You also agree not to use automated devices such as bots or scripts to create multiple accounts.

4Your Username

When you create a Taap.bio account, you will need to choose a suitable username that respects everyone's rights. Your username must be appropriate for all users and must not infringe on anyone's rights, including intellectual property rights like copyright and trademarks.

You cannot use someone else's name (such as a celebrity or brand) without authorization, or choose a username that is offensive, vulgar, or selected solely to profit from it later (commonly known as "username squatting").

If any issues arise with your username, we will assess the situation fairly and may ask you to change it. If you decline, we may suspend or terminate your account. If you have not logged in or seen traffic on your account for more than six (6) months, we may reclaim or reassign your username without notice.

5Managing Your Plan

You can sign up to Taap.bio on a free or paid plan and cancel at any time. Your plan will start when you accept these Terms and continue until you terminate it or we cancel it in accordance with these Terms.

For paid plans, by initiating your first subscription payment, you authorize us to charge you recurring subscription fees on an ongoing basis. Unless you notify us of your intent to cancel your subscription, your subscription will automatically renew and you authorize us to automatically charge your payment method for the subscription fee and any applicable taxes on each renewal date.

If you cancel a paid plan, it will ordinarily continue until the end of your current billing cycle and then automatically convert to a free plan. To cancel, please visit the billing page in your account settings. To the extent permitted by applicable law, payments are non-refundable. However, if you have selected a paid plan but cancel within 72 hours, we may, in our discretion, offer a refund. Please email us at [email protected].

We acknowledge that some jurisdictions have mandatory laws regarding your cancellation rights (including the 14-day withdrawal right under EU consumer protection law), and this section will not override those laws where they apply.

6Your Content

We love the variety of content that our users post on Taap.bio! However, we want to ensure that everyone who visits the Platform can do so safely.

When we talk about your "content," we mean the text, graphics, videos, links, images, and any other materials you add to your Taap.bio profile. You are responsible for your content and you warrant that:

• The content you post is yours, or if you are using third-party materials, you have the necessary rights to share them on Taap.bio and to allow us to use them as per these Terms.
• Your content will not infringe on anyone's privacy, publicity, intellectual property, or any other rights.
• Your content is accurate and honest: it should not be misleading, deceptive, or violate any laws, and it should not harm our reputation.
• Your content is free from harmful elements like viruses or disruptive code that could damage the Platform or other systems.
• Your content does not contain automated collection tools: do not use scripts or scraping tools to gather information from profiles or the Platform.
• You will refrain from posting unauthorized ads, solicitations, or endorsements on Taap.bio.

We reserve the right to remove content or restrict access to content that violates these Terms or that we deem inappropriate, without prior notice.

7License to Your Content

When you post content on your Taap.bio profile, you grant us a license to use, publicly display, distribute, modify, adapt, and create derivative works of such content on the Platform and in our marketing materials. This license is worldwide, royalty-free, and perpetual, which means we can use your content anywhere in the world, without paying you fees, for as long as we operate the service.

You retain all of your rights in your content. Keep in mind that your content will be publicly accessible and may be used and re-shared by others on Taap.bio and across the internet.

Please do not share personal information on Taap.bio that you do not want visible to the world. Never post social security numbers, passport details, or similar sensitive information.

8Intellectual Property

We, as the owners of the Platform, grant you a limited right to use it for sharing content and interacting with other users' content. All rights, including intellectual property rights, related to the Platform (excluding your content) are exclusively owned by CLOUD MIND LINK SOLUTIONS or our licensors.

You do not acquire any rights in our intellectual property, and you are not allowed to use it, including our brand name, logo, or any other proprietary elements, for any purpose without our prior written approval.

As a user, we grant you a limited, revocable, non-exclusive, and non-transferable right to use the Platform for creating, displaying, and uploading content in accordance with these Terms. You must not use scripts, bots, scraping tools, or other automated means to access, download, extract, or collect content or information from Taap.bio profiles or the Platform.

9Fees and Payment

Subscription fees: If you have chosen a paid plan, make sure to pay subscription fees on time. Depending on your location, your subscription fees may include taxes (such as VAT) that are either included in or added to your subscription fees, as required by applicable law.

Subscription fees are billed in advance on a recurring basis, depending on whether you have selected a monthly or annual billing cycle. At the end of each billing cycle, your paid plan will automatically renew unless you decide to cancel.

Changes in fees: We may periodically adjust subscription fees. If any changes are made, we will provide you with reasonable prior notice. If you do not agree with the updated fees, you have the option to cancel your plan before the next billing cycle begins.

10Suspension or Termination of Your Account

If you do not follow these Terms, we have the right to suspend or terminate your account, or take other action regarding your account. The steps we take will depend on the nature of the non-compliance.

We may also suspend or terminate your account if we are required to do so to comply with a legal requirement or court order, or if we reasonably believe it is necessary to prevent harm to you, us, other users, or third parties.

If we suspend or terminate your account, we aim to notify you beforehand, although we are not obligated to do so. You will not receive a refund for any fees paid in advance, unless required by law.

If you have a free account and have not logged in or seen traffic to your account for an extended period of time (for example, 6 months), we reserve the right to terminate your account without notice.

11Privacy

At Taap.bio, safeguarding your privacy is our priority. Our Privacy Policy outlines how we handle your personal data. By using Taap.bio, you acknowledge that you have read and understood our Privacy Policy.

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection laws. You have rights regarding your personal data, including the right to access, rectify, delete, and port your data, as well as the right to object to or restrict certain processing. 12Limitation of Liability

We are not responsible for how you use the Platform, and it is crucial that you maintain backups of your own content. We are not liable for any damages resulting from actions such as downloading, installing, or using the Platform.

You agree to protect us from any losses that arise if you breach these Terms or if a third party raises a claim against us related to your content.

To the extent permitted by applicable law, neither party will be liable for indirect, punitive, special, incidental, or consequential damages, including loss of profits, data, or goodwill.

Our total liability to you under these Terms or related to the Platform will not exceed the greater of the fees you paid us in the 12-month period before the liability arose, or EUR 100.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded by applicable law.

13Disclaimers

When you use Taap.bio and explore any content on the Platform, you do so at your own risk. The Platform is provided to you "AS IS" and "AS AVAILABLE," without any warranties of any kind, whether express or implied.

We do not warrant that the Platform will function uninterrupted or securely, that any errors or defects will be corrected, that the Platform is free of viruses or other harmful components, or that the results of using the Platform will meet your needs.

These disclaimers apply to the maximum extent permitted by law. If you are a consumer in the European Union, you may have statutory rights that cannot be waived, and nothing in these Terms is intended to affect those rights.

14Third-Party Services

Taap.bio may integrate with various third-party products and services. Your use of any third-party products or services connected through Taap.bio is subject to the separate terms and conditions and privacy notices of those third parties.

Unless explicitly stated otherwise, we do not endorse or make any warranties about any third-party products or services, nor do we offer refunds for payments made to third parties.

15Feedback

We love hearing your ideas on how we can make Taap.bio even better! If you share feedback with us, we are free to use it however we like, without payment to you (or to not use it at all).

16Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.

If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of your country of residence that cannot be derogated from by contract.

Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Montbéliard, France, unless you are a consumer, in which case you may also bring proceedings in the courts of your country of residence.

If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.

17General Provisions

These Terms, including the Privacy Policy and any linked policies, constitute the entire agreement between you and us regarding the Platform.

If any part of these Terms is deemed invalid or unenforceable under applicable law, that part will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed, and the remaining Terms will continue in full force and effect.

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

These Terms do not create any agency, partnership, joint venture, or employment relationship between you and us.
